Covering Your eFuse Account and All eFuse Products, Including Sidekick
Effective Date: August 20, 2026
1. INTRODUCTION & SCOPE
This Privacy Policy explains how eFuse, Inc., a Delaware corporation ("eFuse," "we," "us," or "our"), collects, uses, discloses, and protects personal data across the shared eFuse Account and all products eFuse operates, currently including eRena, eGency, and Sidekick (collectively, the "eFuse Products"), together with the eFuse website (https://efuse.gg) and each eFuse Product's own website(s) or application(s) (e.g., https://heysidekick.gg) (collectively, the "Service"). Because a single eFuse Account is used to sign in across the eFuse Products, this Policy is written at the company level, with product-specific sections — most extensively for Sidekick, given its Ad Placement and Creator Advertising Program data flows — called out where a particular eFuse Product's data practices differ from the baseline.
This Policy applies to visitors, registered users ("Creators" on Sidekick, and the equivalent user roles on other eFuse Products), and, for Sidekick specifically, to Stream viewers whose data we process in connection with delivering and measuring Ad Placements on Integration Partner platforms, including Kick. It does not apply to information collected by any other third-party platform directly, which is governed by that party's own privacy policy.
2. WHO WE ARE / DATA CONTROLLER
eFuse, Inc., a Delaware corporation with a registered mailing address of 36 S Paint St, Chillicothe, OH 45601, is the controller (or, in some U.S. state-law terminology, the "business") responsible for the personal data described in this Policy across all eFuse Products, except that with respect to certain Viewer ad-delivery data, eFuse and its Integration Partners may each act as independent controllers of the data each processes for its own purposes, as described in Section 5.5.
3. DEFINITIONS
"Personal Data" / "Personal Information" means any information relating to an identified or identifiable individual, as defined under applicable law (for example, GDPR, CCPA/CPRA, LGPD, or the Privacy Act 1988 (Cth)).
"eFuse Account" means the single account used to register for and sign in to any eFuse Product, as described in Section 4.1.
"eFuse Products" means eRena, eGency, Sidekick, and any other product or service eFuse operates that links to this Policy.
"Creator" means an individual who uses their eFuse Account to access Sidekick and, where applicable, enroll in the Creator Advertising Program.
"Viewer" means an individual who views a Creator's Stream on an Integration Partner platform and, in doing so, may be served an Ad Placement through Sidekick.
"Integration Partner" means a third-party streaming platform or ad-technology partner integrated with Sidekick, including Kick Streaming Pty Ltd ("Kick"), Twitch, YouTube, and Discord.
"Sale" / "Share" have the meanings given under applicable U.S. state privacy law (e.g., the CCPA/CPRA), which can include disclosures of personal information to third parties, including for cross-context behavioral or targeted advertising, even without an exchange of money.
"eFuse User Agreement" means, collectively, this Privacy Policy and the eFuse, Inc. Terms of Use, each as may be amended from time to time.
4. PERSONAL DATA WE COLLECT
4.1 The eFuse Account (All eFuse Products)
When you register, you create a single eFuse Account used to sign into eFuse Products. At registration, we collect email address, username, password (stored in hashed/encrypted form), date of birth, and, optionally, gender. If you register or sign in using a third-party identity provider via OAuth (currently YouTube, Twitch, or Discord), we receive your name, email address, and profile information from that provider instead. The eFuse Account is shared, and as a result this account and profile information is available across all eFuse Products you use, consistent with this Policy. The eFuse Account has a general minimum age of 13 (with parental consent and higher age thresholds in certain countries — see Section 20); Sidekick specifically requires Creators to be 18 or older, as described in Section 20 and the Sidekick Terms and Conditions.
4.2 Information We Collect Automatically (All eFuse Products)
We collect the following automatically:
- Device and technical data: IP address, browser type, operating system, device identifiers, and similar technical data collected when you access any eFuse Product.
- Usage data: pages viewed, features used, and interaction data within the relevant eFuse Product.
- Cookies and similar tracking technologies, as described in Section 7.
4.3 Communications (All eFuse Products)
We collect information you provide when you contact support or otherwise communicate with us, regardless to which eFuse Product your inquiry relates.
4.4 Sidekick-Specific Information
The following categories of information are specific to Sidekick and the Creator Advertising Program. Some of this information — specifically, the stream chat and viewership data described below — is also used in connection with eGency's brand-insight and analytics services, as described in the eGency Data Platform bullet below.
- Payments reference your linked payout account identifier and, where required for tax compliance, your legal name, address, and tax identification information.
- Performance and audience metrics for Creator Streams, provided to eFuse to enable ad delivery, measurement, and revenue-share reporting under the integration agreements with our Integration Partners.
- Creator opt-in/opt-out status for the Creator Advertising Program, as maintained by our Integration Partners and reported to eFuse.
- Ad delivery and measurement data such as impression, completion, and performance data for Ad Placements served on our Integration Partners’ platforms, provided on a server-side basis.
- eFuse's eGency Data Platform ingests and stores, in real time, chat messages posted in a Creator's live stream on each of Sidekick's supported livestream platforms together with a timestamp and the associated streamer's attribution. EDP also records historical viewership data (concurrent-viewer counts captured through each Integration Partner’s platform's API at the moment an Ad Placement is delivered) and Creator/Stream performance metrics. We use automated systems, including AI/large language model analysis of chat content, to (a) determine Ad Placements, (b) generate brand-insight reports, and (c) perform Brand Lift sentiment analysis of audience reaction. This analysis is based on chat text content, not voice, video, or other biometric data; see Section 9 for our AI transparency practices.
- Where eFuse integrates with a Creator's Discord community, eFuse ingests Discord chat content and related guild (server) analytics for community-analytics purposes only. Discord data is not used for livestream Ad Placement delivery.
We retain this information no longer than reasonably necessary for the purposes described above, or as required by law; see Section 8.
4.5 Information About Sidekick Viewers
When an Ad Placement is delivered to a Viewer on a Creator's Stream, eFuse and/or its advertising partners may process limited technical data about that Viewer's device and ad interaction (such as IP address, approximate location derived from IP, device/browser identifiers, and ad-interaction data such as impressions and click-through) for ad delivery, frequency-capping, measurement, and fraud/invalid-traffic detection. eFuse does not require Viewers to create an eFuse Account and does not knowingly collect Viewer data beyond what is reasonably necessary for these purposes.
4.6 Sensitive Categories
"Sensitive Personal Information" includes, as applicable under U.S. state privacy law: government identification numbers, financial account details, precise geolocation, the content of communications, genetic or biometric data processed for identification, health or sexual-orientation information, and racial, ethnic, religious, or union-membership information.
eFuse does not intentionally collect biometric identifiers processed for identification, precise geolocation, government identification numbers (other than tax identifiers described in Section 4.4), health information, or other Sensitive Personal Information beyond what is described above.
5. HOW WE USE PERSONAL DATA
5.1 Purposes — All eFuse Products
- To provide, maintain, and improve the eFuse Account and each eFuse Product;
- To communicate with you about the Service, including operational notices and, where you have consented or as otherwise permitted by law, marketing communications;
- To detect, investigate, and prevent fraud, abuse, and security incidents;
- To comply with legal, tax, and regulatory obligations, including sanctions screening; and
- To enforce our Terms of Use/Terms and Conditions and protect the rights, safety, and property of eFuse, our users, and third parties.
5.2 Purposes — Sidekick-Specific
- To operate the Creator Advertising Program and calculate, report, and pay Creators the amounts reflected in their Sidekick account; and
- To select, target, deliver, measure, and optimize Ad Placements, including Programmatic Advertising and international ad placements delivered through our Integration Partners or advertising exchanges.
5.3 Automated Processing and Ad Personalization (Sidekick)
eFuse and its advertising partners may use automated, algorithmic systems to select and target Ad Placements based on stream metadata, audience analytics, and Viewer technical signals. This automated processing informs which ads are shown; it does not make legal or similarly significant decisions about individual Creators or Viewers (such as decisions about eligibility for credit, employment, housing, insurance, or similar). Where automated processing does have a legal or similarly significant effect on you, you have the rights described in Section 15 (EEA/UK) and Section 9 (Automated Decision-Making and AI Transparency).
5.4 No Sale of Data for Money; Possible "Sharing" for Advertising
eFuse does not sell personal data to third parties in exchange for money. However, because Sidekick Ad Placements are delivered through advertising exchanges and Integration Partners, our disclosures for ad-delivery and measurement purposes may constitute a "sale" or "share" of personal information under some U.S. state privacy laws (which define those terms broadly to include certain disclosures for cross-context behavioral advertising). See Section 14 for the opt-out rights this triggers for residents of applicable states.
5.5 Role as Controller vs. Processor
With respect to eFuse Account data and Sidekick payout data, eFuse acts as a controller / business. With respect to certain Viewer ad-delivery data processed solely to fulfill eFuse integrations with our Integration Partners’ platforms, eFuse and its Integration Partners may each act as independent controllers of the data each processes for its own purposes, consistent with the confidentiality and data-handling terms of their commercial agreement.
6. LEGAL BASES FOR PROCESSING (EEA/UK)
Where the GDPR or UK GDPR applies, we rely on the following legal bases: (a) performance of a contract, to provide the eFuse Account, the eFuse Products, and (for Sidekick) pay Creator revenue share; (b) legitimate interests, to deliver and measure advertising, prevent fraud, and improve the Service, balanced against your rights and interests; (c) consent, for non-essential cookies, similar tracking technologies, and marketing communications, which you may withdraw at any time; and (d) legal obligation, for tax, sanctions-screening, and regulatory compliance.
7. COOKIES AND SIMILAR TRACKING TECHNOLOGIES
We use only a limited set of first-party cookies that are strictly necessary to operate the Service, categorized as follows:
- Authentication and session Cookies used to keep you signed in to your eFuse Account, maintain session state, and support core account and security functionality.
- Security Cookies (Cloudflare) used by our content-delivery and security provider, Cloudflare, for bot mitigation, rate-limiting, and abuse/attack prevention.
These Cookies fall within the "strictly necessary" exemption recognized under the ePrivacy Directive (as implemented across the EEA) and the UK's Privacy and Electronic Communications Regulations, so we do not display a cookie-consent banner or operate a consent-management platform: strictly necessary Cookies do not require your opt-in consent. We do not currently use analytics, advertising, or targeting Cookies of our own, and we do not use Google Analytics or any similar first-party analytics tool. If that changes, we will update this Section, implement the appropriate consent mechanism (opt-in in the EEA/UK, as applicable) before any non-essential Cookie is set, and provide the notice described below.
Even though these Cookies do not require consent, we still disclose them here, consistent with the ePrivacy Directive's information requirement and the transparency principles of the GDPR and UK GDPR, which apply even to Cookies that are exempt from consent.
This Section covers only Cookies set through eFuse's own websites and applications. When you watch a Stream or view Ad Placements on any Integration Partner’s platform, or interact with another Integration Partner's platform, that Integration Partner may set its own cookies or similar technologies, governed by that Integration Partner's own cookie and privacy policies, not this one; see Section 21.
8. RETENTION
We retain personal data for as long as needed to provide the Service, comply with legal, tax, and accounting obligations, resolve disputes, and enforce our agreements. Sidekick payout and tax-related records are generally retained for the period required by applicable tax law. Retention periods for Sidekick ad-delivery and measurement logs are reviewed and updated periodically to ensure they are consistent with industry ad-measurement practice, after which they are deleted or aggregated/de-identified.
9. AUTOMATED DECISION-MAKING AND AI TRANSPARENCY
We do not currently use generative AI to create user-facing content, and no output presented to you is represented as being authored by a human when it is not. We do use automated systems to analyze text content (such as chat and stream transcripts) and telemetry data (such as gameplay and stream-performance data) for purposes including identifying notable moments in a Stream and informing decisions about Ad Placement delivery. This analysis is based on text and telemetry data only — it does not use voice, video, facial, or other biometric data, and does not identify or infer your emotions on the basis of biometric data. Because it does not rely on biometric data, this analysis does not constitute "emotion recognition" as that term is defined under the EU AI Act.
If we introduce generative AI for user-facing content in the future (for example, AI-assisted suggestions shown to Creators), we will disclose that use here, will not represent AI-generated output as human-authored, and will apply the transparency measures the EU AI Act and comparable laws require, including labeling AI-generated or manipulated synthetic content where required.
You have the right, where applicable law provides it, not to be subject to a decision based solely on automated processing that produces legal or similarly significant effects concerning you, and, where such decisions occur, to obtain human review, express your point of view, and contest the decision.
10. HOW WE DISCLOSE PERSONAL DATA
We disclose personal data to the following categories of recipients:
- Other eFuse Products are shared, so your account and profile information is available across eRena, eGency, and Sidekick, each of which may use it consistent with this Policy and any applicable product-specific terms;
- Integration Partners (Sidekick), to enable Ad Placement delivery, measurement, revenue-share reporting, and the Creator opt-in/opt-out mechanism;
- Advertising exchanges, demand-side platforms, and advertisers who purchase Sidekick Ad Placements, on a limited basis reasonably necessary for ad delivery and measurement, including our Integration Partners’ own advertising exchange/demand-side integrations;
- Service providers who perform functions on our behalf, such as cloud hosting (Cloudflare, Sentry, SendGrid; MongoDB, Inc.; Amazon Web Services, Inc.; and Datadog Inc.), customer support and for Sidekick payments (Tipalti, Inc.);
- Professional advisors and regulators, where necessary for legal, tax, audit, or compliance purposes;
- Parties to a corporate transaction, such as a merger, acquisition, financing, or sale of assets, subject to confidentiality obligations; and
- Law enforcement or other third parties where required by law, legal process, or to protect the rights, safety, and property of eFuse, our users, or others.
We require our service providers and Integration Partners to protect personal data consistent with this Policy and applicable law, and, where required, through written data processing terms.
10.1 Legal Process (U.S. Users)
Where U.S. law applies, our disclosure of the contents of communications and other account records in response to government legal process is governed by the Stored Communications Act, 18 U.S.C. § 2701 et seq. (including the additional protections in 18 U.S.C. § 2702), and we provide notice to affected users where legally permitted and required. We generally retain account records for at least one year following a known Terms violation to support investigation, legal process, and enforcement.
11. INTERNATIONAL DATA TRANSFERS
eFuse is based in the United States, and eFuse's infrastructure is currently hosted primarily in the United States. Because Sidekick supports Creators and Viewers on its Integration Partners’ platforms globally, and other eFuse Products may have their own international user base, personal data may be transferred to, stored, and processed in the United States and other countries that may not have data protection laws equivalent to those in your home jurisdiction. Where we transfer personal data out of the EEA, UK, or Switzerland, we rely on recognized transfer mechanisms, which may include: (a) the EU-U.S. Data Privacy Framework (and the UK extension and Swiss-U.S. Data Privacy Framework), to the extent eFuse is self-certified; (b) the European Commission's Standard Contractual Clauses and, for UK transfers, the UK International Data Transfer Addendum; and/or (c) other lawful transfer mechanisms as applicable, together with supplementary technical, contractual, and organizational safeguards where required following applicable "Schrems II" guidance.
12. SECURITY
We use administrative, technical, and organizational safeguards designed to protect personal data against unauthorized access, disclosure, alteration, and destruction, including encryption in transit, access controls, and vendor security review. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. If we become aware of a security incident affecting personal data, we will notify affected individuals and/or regulators as required by applicable law (for example, within 72 hours of becoming aware under GDPR Article 33, where applicable).
13. YOUR PRIVACY RIGHTS — OVERVIEW
Depending on your location, you may have some or all of the following rights over your personal data: to know/access, correct, delete, port, restrict or object to processing, opt out of sale/sharing/targeted advertising, withdraw consent, and lodge a complaint with a data protection authority. Section-specific detail for major jurisdictions follows. To exercise any right, contact us using the details in Section 20; we will verify your request and respond within the time required by applicable law.
14. CALIFORNIA AND OTHER U.S. STATE PRIVACY RIGHTS
14.1 Categories of Personal Information (CCPA/CPRA)
In the twelve months preceding the effective date of this Policy, we have collected the categories of personal information described in Section 4, which map to the CCPA/CPRA categories of identifiers, internet/network activity, geolocation (approximate, IP-derived), commercial information (Sidekick payout/tax data), and audio/visual data only to the extent inherent in Sidekick Stream metadata (we do not separately collect biometric identifiers). We disclose these categories to the recipients identified in Section 10 for the business purposes identified in Section 5.
14.2 Your California Rights
- Right to know/access the specific pieces and categories of personal information we have collected, used, disclosed, and sold/shared;
- Right to delete personal information, subject to exceptions;
- Right to correct inaccurate personal information;
- Right to opt out of the sale or sharing of personal information (including for cross-context behavioral advertising) — see Section 5.4;
- Right to limit use and disclosure of sensitive personal information (we do not use sensitive personal information beyond what is necessary to provide the Service);
- Right to non-discrimination for exercising your rights; and
- Right to designate an authorized agent to submit requests on your behalf.
14.3 Automated Decision-Making Technology (ADMT)
Under the CCPA regulations effective January 1, 2026, California's ADMT rules primarily govern automated processing used for "significant decisions" (such as financial, employment, housing, education, or healthcare eligibility) and generally exclude first-party advertising. Sidekick's use of automated systems for ad targeting and delivery does not make significant decisions about you within the meaning of these regulations; if that changes, we will update this Policy and provide any required pre-use notice and opt-out.
14.4 Global Privacy Control
We honor the Global Privacy Control (GPC) signal, where legally required, as a valid request to opt out of the sale/sharing of personal information for browsers/devices on which it is enabled.
14.5 Other State Laws
Residents of other states with comprehensive privacy laws in effect — currently including but not limited to Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, Delaware, Iowa, Nebraska, New Hampshire, New Jersey, Minnesota, Maryland, Tennessee, Indiana, Kentucky, Rhode Island, and Arkansas — have similar rights to know, access, correct, delete, port, and opt out of targeted advertising, the sale of personal data, and, in most states, profiling in furtherance of decisions producing legal or similarly significant effects. These rights are available to residents of the states listed above who interact with our websites, including individuals who access an eFuse Product without creating an eFuse Account, to the extent we process their personal information. Where a state's privacy law does not yet extend comprehensive rights of this kind, or where our processing of a particular state's residents' data does not meet that state's applicability threshold, we nonetheless extend the same rights described in this Section as a matter of company policy to any U.S. resident who contacts us to exercise them.
14.6 Minors Under State Law
Sidekick accounts are limited to individuals 18 and older, so Sidekick-specific processing should not implicate state minor-specific provisions (for example, opt-in requirements for the sale of data from consumers the business has actual knowledge are under 13-16, depending on the state). The general eFuse Account has a minimum age of 13 with parental consent, consistent with the tiered age framework in Section 20; California residents under 16 have the additional opt-in rights described below for any data sold or shared in connection with the eFuse Account generally.
14.7 "Shine the Light" (California Civil Code § 1798.83)
California residents may request, once per calendar year and free of charge, information about the categories of personal information we have disclosed to third parties for those third parties' direct marketing purposes in the preceding calendar year, and the identity of those third parties. To make such a request, contact us using the details in Section 23 with "Shine the Light Request" in the subject line.
15. EEA, UK, AND SWITZERLAND — GDPR RIGHTS
If the GDPR or UK GDPR applies to you, you have the right to: access your personal data; rectify inaccurate data; erase your data ("right to be forgotten"); restrict processing; data portability; object to processing based on legitimate interests or for direct marketing; withdraw consent at any time without affecting prior lawful processing; and lodge a complaint with your local supervisory authority (in the UK, the Information Commissioner's Office).
16. CANADA — PIPEDA
If you are located in Canada, our collection, use, and disclosure of your personal information is also governed by the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial law. You have the right to access and correct your personal information and to withdraw consent, subject to legal or contractual restrictions, and may direct a complaint to the Office of the Privacy Commissioner of Canada.
17. BRAZIL — LGPD
If you are located in Brazil, we process your personal data consistent with the Lei Geral de Proteção de Dados (LGPD). You have the right to confirmation of processing, access, correction, anonymization, blocking or deletion of unnecessary or excessive data, portability, information about sharing, information about the possibility of denying consent, revocation of consent, and the right to lodge a complaint with the Autoridade Nacional de Proteção de Dados (ANPD).
18. AUSTRALIA — PRIVACY ACT AND AUSTRALIAN PRIVACY PRINCIPLES
We handle personal data consistent with the Australian Privacy Principles (APPs) under the Privacy Act 1988 (Cth), as amended by the Privacy and Other Legislation Amendment Act 2024 and subsequent reform tranches. You have the right to access and correct your personal information, to know how it is collected and used, and to make a complaint, first to us and, if unresolved, to the Office of the Australian Information Commissioner (OAIC).
The OAIC's Children's Online Privacy Code, expected to be registered no later than 10 December 2026, will impose enhanced obligations on entities that provide a social media service, relevant electronic service, or designated internet service likely to be accessed by children. Based on the Code's exposure draft and current guidance, that obligation attaches to the entity that provides the platform a child directly uses — for example, our Integration Partners — and not to eFuse as a third-party advertiser that delivers Ad Placements onto those platforms without operating them. eFuse does not knowingly enable Sidekick's Creator features for anyone under 18, and Sidekick does not itself provide a direct service likely to be accessed by children. This reading reflects the Code's current, not-yet-finalized text; we will revisit this Section before the Code's registration deadline and update it if the final Code addresses advertising intermediaries differently than the exposure draft does.
19. JAPAN — ACT ON THE PROTECTION OF PERSONAL INFORMATION (APPI)
If you are located in Japan, we handle personal information consistent with the APPI, including providing notice of the purposes of use, obtaining consent where required for provision of personal data to third parties (including for cross-border transfer), and honoring requests for disclosure, correction, and suspension of use of personal information submitted to the contact in Section 20.
20. CHILDREN'S PRIVACY
20.1 General eFuse Account Minimum Age: 13
The eFuse Account (covering eFuse, eRena, and eGency) is not intended for children under 13 years of age, and we do not knowingly collect personal information from a child under 13 without parental consent. If we learn we have collected personal information from a child under 13 without the required consent, we will delete it. A parent or guardian who believes we hold personal information from a child under 13 without consent may contact us using the details in Section 23.
20.2 Higher Age Thresholds in Certain Countries
Some countries set a minimum age for consent to data processing higher than 13; where applicable, we apply the following thresholds for eFuse Account registration, consistent with GDPR Article 8 and local implementing law:
- Age 14: Austria, Bulgaria, Cyprus, Italy, Lithuania, Peru, South Korea, and Spain;
- Age 15: Czech Republic, France, Greece, Serbia, and Slovenia;
- Age 16: Croatia, Germany, Hungary, Ireland, Luxembourg, the Netherlands, Poland, Romania, San Marino, and Slovakia.
A user below the applicable threshold in their country may only create an eFuse Account with verifiable parental or guardian consent, where our registration flow supports that consent mechanism. California residents under 16 have additional opt-in rights over the sale or sharing of their personal information, described in Section 14.6.
20.3 Sidekick: Minimum Age 18, Regardless of the eFuse Account Threshold
Sidekick's Creator Advertising & Revenue-Share Program has a stricter, independent minimum age of 18, regardless of the thresholds in Sections 20.1 and 20.2. We do not knowingly enable Sidekick's Creator features for anyone under 18. If we learn that a user under 18 has enrolled in the Program, we will terminate that access and delete the associated Sidekick-specific personal data described in Section 4.4, subject to legal retention obligations, without necessarily affecting that individual's broader eFuse Account (if they otherwise meet the 13+ threshold for the other eFuse Products).
20.4 Sidekick Viewers
As described in Sections 4.5 and 9, Sidekick Ad Placements delivered to Viewers (who do not need an eFuse Account) may reach individuals under 18 or under the locally applicable age of majority. We do not knowingly engage in behavioral or targeted advertising to a Viewer we actually know to be a child under applicable law, and we apply the additional safeguards described in Section 6.5 of the Sidekick Terms and Conditions.
21. THIRD-PARTY LINKS AND INTEGRATION PARTNER PLATFORMS
The Service may link to or be accessed through our Integration Partners and other third-party platforms. This Policy does not apply to the data-handling practices of our Integration Partners or any other third party; please review our specific Integration Partners’ own privacy policies for information about how they handle your data on their platforms.
22. CHANGES TO THIS POLICY
We may update this Policy from time to time. We will post the updated Policy with a revised effective date and, for material changes, provide additional notice (such as an email or in-Service notice) as required by applicable law.
23. CONTACT US / EXERCISE YOUR RIGHTS
